These Terms of Service ("Terms") govern your access to and use of the website, products, and services offered by Revivify Labs ("Revivify Labs," "we," "us," or "our"), including any orders you place with us (collectively, the "Services"). By using the Services or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements. The Services are intended for use only by adults in the United States.

2. Your Account

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to notify us immediately of any unauthorized use of your account.

3. Orders, Pricing, and Availability

All orders placed through the Services are offers to purchase products subject to acceptance by Revivify Labs. We reserve the right to refuse, limit, or cancel any order — including for reasons of suspected fraud, pricing errors, or product unavailability — at our sole discretion.

Prices, promotions, and product availability are subject to change without notice. While we make every effort to display accurate information, we do not warrant that product descriptions or other content on the Services are error-free. In the event of a pricing or product description error, we reserve the right to correct the error and, if your order is affected, contact you for instructions or cancel and refund your order.

4. Payment

Payment is due at the time of order. We accept major credit and debit cards and other payment methods displayed at checkout. By providing payment information, you authorize us (or our payment processor) to charge your selected payment method for the total order amount, including any applicable taxes and fees.

5. Subscriptions and Auto-Renewal

If you enroll in our subscription program ("Your Protocol"), you authorize us to automatically charge your payment method on file for each scheduled order at the price and frequency you selected. Subscription orders renew automatically until you cancel.

Pricing. Subscription pricing is shown at checkout. We may change subscription pricing in the future; if we do, we will notify you in advance and you will have the opportunity to accept or cancel.
Skipping, pausing, and canceling. You can skip, pause, swap products, change frequency, or cancel your subscription at any time from your account dashboard, with no fees or penalties. Changes must be made before your next scheduled processing date to apply to that shipment.
Failed payments. If your payment method fails, we may retry the charge and/or pause your subscription until a valid payment method is provided.

6. Promotions and Discount Codes

Discount codes and promotional offers are subject to the specific terms displayed with each promotion. Unless otherwise stated, codes are limited to one per customer and per order, cannot be combined with other offers, and are not redeemable for cash. We reserve the right to modify or cancel any promotion at any time.

7. Health Disclaimer (Important)

Revivify Labs products are dietary supplements, not pharmaceuticals. Statements made about our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

The information on the Services — including blog posts, product descriptions, and educational content — is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

Consult your physician or qualified healthcare provider before beginning any new supplement, especially if you are pregnant, nursing, taking prescription medications (including SSRIs, MAOIs, or other psychiatric medications), have a medical condition, or are scheduled for surgery. Discontinue use and seek medical attention if you experience any adverse reaction. Keep all products out of reach of children.

8. Intellectual Property

All content on the Services — including text, graphics, logos, icons, images, photographs, audio, video, software, product names, and the "look and feel" of the site — is owned by Revivify Labs or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, transmit, display, or create derivative works from any content on the Services without our prior written permission, except as expressly permitted by these Terms.

We grant you a limited, revocable, non-exclusive license to access and use the Services for personal, non-commercial purposes.

9. User Content

If you submit a product review, testimonial, comment, photo, or other content to the Services ("User Content"), you grant Revivify Labs a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in any media for any purpose, including marketing.

You represent that you own or have the right to submit any User Content and that it does not infringe on the rights of any third party. We reserve the right to remove any User Content at our sole discretion.

10. Prohibited Uses

You agree not to use the Services to:

Violate any law or regulation;
Infringe on the intellectual property or other rights of any party;
Harass, abuse, or harm another person;
Submit false, misleading, or fraudulent information;
Upload viruses, malware, or other malicious code;
Attempt to interfere with the security or proper functioning of the Services;
Use automated tools (such as bots or scrapers) to access the Services without our prior written consent;
Resell or redistribute our products without our prior written consent.

11. Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATIONS OR WARRANTIES THAT OUR PRODUCTS WILL ACHIEVE ANY PARTICULAR RESULT FOR YOU. INDIVIDUAL RESULTS MAY VARY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVIVIFY LABS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR ANY PRODUCT, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Revivify Labs and its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) any User Content you submit.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including for violation of these Terms. The provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and Revivify Labs regarding the Services and supersede any prior agreements.
